(A) Breach of statutory duty simpliciter

Claim alleges: statutory duty; breach of that duty, causing damage to the plaintiff

Breach of statutory duty not by itself five rise to any private law cause of action

Private law cause of action may arise if:

(1) statutory duty imposed for the protection of a limited class of the public; and

(2) Parliament intended to confer on members of that class a private right of action for breach of the duty

(a) if no other remedy + intention to protect established: may indicate that there be a private law of action

(b) if there exists another remedy, indicates that the statutory right was intended to be enforceable by other means and not by private right of action
