2.没约定履行地<br>
“无约定或约定不明，争议标的为给付货币的， 接收货币一方所在地为合同履行地”<br>
自然人之间，实践合同，借款人收到钱之前合同未生效，谈不上合同履行。出借人支付钱后合同生效，实质为“单务合同”，借款人负有向出借人返还借款义务，此时“接受一方”即为出借人所在地，也即合同履行地。<br>
其他主体，诺成合同，若出借人答应放贷而未放贷，借款人追究其违约责任的，则“接受”一方应为借款人所在地；若借款人不还款，出借人主张权利的，则“接受”一方应为出借人所在地。<br>
《最高院关于如何认定借款合同履行地问题的批复》与上述分析有冲突，但王林清认为，该批复不应再作为确定履行地的依据，关于这一问题，《民间借贷规定》已作新规定，这一规定与《民事诉讼法解释》及《合同法》第62条第3项一脉相承 <br>
